Wednesday's proposal will look at the judicial body that presides over the EU's dealings with Iceland, Liechtenstein and Norway, albeit not as a model to replicate, according to two government officials familiar with the document. Britain is "putting forward imaginative and creative solutions to build a deep and special partnership with our closest neighbors and allies".

Today's paper is the latest in a series being published this week.

The prime minister is caught in a bind because conceding on the ECJ would mark a U-turn and draw complaints from those who campaigned to leave, while failing to find a solution would prompt the European Union to delay the start of talks on a new trade deal. Services make up 80 percent of the gross value added to the British economy, compared with an EU-wide 74 percent.

Further papers are due in the coming days, including one on the crucial issue of the European Court of Justice - a sticking point in talks.

"To enable small businesses to engage in easy cross-border trade with the EU27 after Brexit, new arrangements for civil judicial cooperation must ensure legal certainty, easy and effective access to justice, clear designation of the applicable law where appropriate and recognition and enforcement processes that are both speedy and effective", FSB National Chairman Mike Cherry said.

'The optimum outcome for both sides will be an agreement reflecting our close existing relationship, where litigating a cross-border case involving United Kingdom and European Union parties under civil law, wherever it might take place, will be easier, cheaper and more efficient for all involved, ' the paper states.

The government also emphasised that current negotiations about the divorce are "inextricably" linked to future trade arrangements and should therefore be discussed at the same time.
