Federal judge orders State Dept. to recover Clinton aides' Benghazi emails

While the State Department has said a search of its database "is likely to be unfruitful", the judge is ordering the search to determine "the adequacy of State's search for responsive records".

Judge Mehta, an Obama appointee, explained that the State Department is unlikely able to "adequately" access emails sent from Clinton's private server.

Mehta said that concern "overstates the outcome of the court's ruling" given the unique circumstances involved, namely the widespread use of private emails and a personal email server.

Using Freedom of Information Act (FOIA) requests, Judicial Watch had already successfully compelled the State department turn over email messages it requested Clinton turn over in 2014 after officials realized she had used a personal email account while she was State Secretary.

Specifically, Judge Amit Mehta asked for emails from or to then-Secretary of State Hillary Clinton between aides Huma Abedin, Cheryl Mills or Jake Sullivan at state.gov addresses.

Before the recent ruling, the State Department had searched tens of thousands of emails handed over to the agency by Ms Clinton and three of her top aides.

He wrote in his opinion that the State Department "has not, however, searched the one records system over which it has always had control and that is nearly certain to contain some responsive records: the state.gov email server".

"It is remarkable that we had to battle both the Obama and Trump administrations to break through the State Department's Benghazi stonewall", Fitton added. He further ordered the department to dig deeper and provide all of the emails that are responsive to Judicial Watch's March 2015 FOIA request. "Why are Secretary Tillerson and Attorney General Sessions wasting taxpayer dollars protecting Hillary Clinton and the Obama administration?"

The judge signed the order on Tuesday requiring a status report by September 22.

Clinton turned over approximately 30,000 emails discussing State business, including the Benghazi attack. The US ambassador to Libya at the time, Chris Stevens, was one of those killed.

He said it was obvious, however, that the State Department was not interested in complying with FOIA requests related to Benghazi. "Although no one can say with certainty, I firmly believe a relatively small contingent of armed military guards would have prevented the attack, and those four lives would not have been lost".
