Facts about retrial of Bill Cosby on sex assault charges

  • Judge Declares Mistrial in Cosby Sexual Assault Case

Days later, and little is known about what went on behind closed doors.

Pennsylvania law allows the public release of jurors' identities, but judges have discretion to keep them a secret under certain conditions. O'Neill kept the jurors names under seal. Prior to the said deliberation, Judge Steven O'Neill said the case was deadlocked and asked the court to try deliberating again.

It would be reasonable, based on the evidence presented, for the jurors to agree that Cosby is a sexual predator and still disagree on a verdict as to the assault of Constand. It is not yet clear why jurors could not reach a verdict, or how close they came. As Fox News reports, jury alternate Mike McCloskey told the local media that he felt "ridiculously sick" about the lack of verdict in the case. Cosby was charged shortly before the statute of limitations was set to expire.

McCloskey posted his juror ID badge on Facebook to prove he was on the alternate jury.

O'Neill, who has already had the case for almost two years, sounded skeptical.

Jurors deliberated more than 52 hours over six days before telling a judge they couldn't break their deadlock.

"We have no indication of where anybody was on the case and I don't know that we will ever know", Steele said.

While Bill Cosby celebrated Saturday's mistrial in the sexual assault trial involving former Temple University employee Andrea Constand, prosecutors are not ready to let the matter drop and have vowed a second trial.

Prosecutors are fighting to keep the jurors' identities a secret, arguing in court documents Monday that releasing them would result in a "publicity onslaught" and make picking a jury for the second trial more hard.

The jurors for the first trial were already hard to find and chosen from a pool in Pittsburgh rather than Philadelphia where the alleged sexual assault took place and the trial was held. Typically, prosecutors have that long to decide whether to retry someone in Pennsylvania.

In a motion filed Monday, Montgomery County District Attorney Kevin Steele said, "This publicity onslaught may have a chilling effect on future jurors in this remarkably high-profile case".

On the opposite side of drama from Camille Cosby, more than half a dozen women who have publicly asserted that they were sexually assaulted by the comedian appeared in court as spectators during the trial to support Constand. And Mrs. Cosby's power is back.

After so many allegations across so many decades, it's astounding that Cosby has been able to walk away unpunished by the criminal justice system, if not unscathed. The 2004 encounter at Cosby's suburban Philadelphia estate was the only one to result in criminal charges. It has also been reported that the prosecution may bring up Constand's sexuality in their second attempt at convicting Cosby.

But McMonagle and Agrusa argued Cosby was the victim of false accusations and that the entertainer and Constand had a "romantic relationship" and consensual sexual contact during the 2004 incident.
