Wife of man facing deportation hopes for reunion

In a 165-page opinion obtained by the Denver Post, Chief Arapahoe County District Judge Carlos Samour Jr. ordered his release. He then held a steady job installing glass, got married and has a stepson, Justus, 10, and son JoJo, 7, who was born while he was out of prison. The family is still looking for answers about what comes next.

On Tuesday, Lima-Marin's wife Jasmine bought balloons and gifts in anticipation of his return, but those gifts remain on stand by as the worry now shifts to the possibility of deportation.

Lima-Marin was "ordered removed" by a federal immigration judge in Denver on November 1, 2000, ICE said in a statement to the Post.

"We released him directly to them", Fairbairn told The Colorado Independent, calling the procedure routine.

"We just have to wait", Jasmine Lima-Marin said. Do you think they need to tone it down?

"We can't imagine the emotional roller coast this family has endured".

"Everyone is completely devastated".

The statement noted that the department is required to notify ICE of a such a possibility and that the detainer was subsequently confirmed. "I just don't know what they're doing". But Immigration and Customs Enforcement can request that an inmate suspected of an immigration violation be held after their release from jail or prison under a form referred to as a hold or a detainer.

Complicating the issue, though, is that Cubans in America are protected under the Cuban Refugee Act, which limits deportations to Cuba regardless of certain criminal convictions. But there have been recent policy changes between the United States and Cuba regarding repatriotization. Lima-Marin was sent back to prison after being mistakenly released 90 years early. He was mistakenly released on parole in 2008. But since he was from Cuba, he wasn't a priority, she says. He was regularly attending ICE check-ins, but he missed his last one in March 2014 when he was sent back to prison. He has not yet said publicly whether he meant to reverse specific policies.

"If all these things hadn't changed under Trump I could think that it's a misunderstanding that would be cleared up".

Martinez said Hickenlooper has been in contact with Together Colorado's local immigration office and has been supportive of the family. The same will stand for Lima-Marin.

A resolution asking Gov. John Hickenlooper to grant clemency to Lima-Marin was unanimously approved on the state Senate floor earlier this month.

Today, Salazar said he felt "gut-punched" when he heard the news that ICE agents had intercepted Lima-Marin's release.

"Anytime you're in ICE custody, you're in fear of deportation, " Diego told the Denver Post.

His wrongful release in 2008 was due to an error in paperwork that said Lima-Miran's sentences were to be served concurrently, instead of consecutively according to CNN.

"At the end of the day, the Court concludes that it would be utterly unjust to compel Lima-Marin, at this juncture, to serve the rest of his extremely long sentence", Samour wrote in his court order. "The family has shown awesome strength and we hope this is a temporary stop on his way to being reunited with his family".
